1. Acceptance of terms

By creating an account or using VoxBurst ("the Service"), you agree to these Terms of Service. The Service is operated by FORTHEAN LABS LLC. If you do not agree, do not use the Service.

2. Account terms

  • You must be 18 years or older (or the age of majority in your jurisdiction) to use the Service.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate information when creating your account.
  • You must keep your login credentials secure and notify us immediately of any unauthorized access.
  • One person or legal entity may not maintain more than one free account.

3. Acceptable use

You may use VoxBurst for lawful purposes only. You must not:

  • Violate the terms of service of any connected social media platform
  • Send spam, unsolicited commercial messages, or use the Service for mass automated messaging not permitted by platform rules
  • Use the Service to post content that is illegal, harmful, threatening, abusive, defamatory, or infringes third-party rights
  • Attempt to gain unauthorized access to the Service or its infrastructure
  • Reverse-engineer, decompile, or disassemble the Service
  • Use the Service in a way that adversely affects the Service's availability or performance for other users
  • Resell or sublicense access to the Service without our written permission (except as enabled by white-label plan features)

4. Payment and billing

  • Paid plans are billed monthly or annually in advance.
  • All fees are non-refundable except as required by law or as stated in our refund policy.
  • We may change our pricing with 30 days' notice. Your current billing cycle will not be affected.
  • If payment fails, your account may be downgraded or suspended after a grace period.

5. Content ownership

You retain full ownership of all content you create and publish through VoxBurst. By using the Service, you grant us a limited license to store, process, and transmit your content solely for the purpose of providing the Service.

We do not claim ownership of your content and do not use it to train AI models without your explicit consent.

6. Service availability

We aim for high availability but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, third-party platform outages, or circumstances outside our control. We are not liable for any losses resulting from service downtime.

7. Termination

You may cancel your account at any time from your account settings. We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice. Upon termination, your data will be deleted in accordance with our Privacy Policy.

8. Disclaimer of warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or free from security vulnerabilities.

9. Limitation of liability

To the maximum extent permitted by law, FORTHEAN LABS LLC is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising from these Terms is limited to the amount you paid us in the 12 months preceding the claim.

10. Governing law

These Terms are governed by the laws of the applicable jurisdiction. Any disputes shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.

11. Changes to terms

We may update these Terms at any time. We will provide at least 14 days' notice for material changes via email or in-app notification. Continued use of the Service after changes take effect constitutes acceptance.
